These Terms of Use ("Terms") govern your access to and use of the Skinvio mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using any features of Skinvio, you confirm that you:

Are at least 13 years of age
Have the legal capacity to enter into these Terms
Will comply with all applicable laws and regulations
Have read and agree to our Privacy Policy

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Medical Disclaimer and Limitation of Liability

SKINVIO IS A SKINCARE WELLNESS APP AND IS NOT A MEDICAL DEVICE, DIAGNOSTIC TOOL, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

The App provides general skincare wellness information, skin analysis, and product recommendations for informational purposes only. The App does not provide medical advice, diagnosis, or treatment. You should always:

Consult a qualified dermatologist or healthcare professional for any skin conditions, health concerns, or medical questions
Seek professional medical advice before starting any new skincare treatments or products
Never disregard professional medical advice or delay seeking it because of information provided by Skinvio
Discontinue use of any products that cause irritation or adverse reactions

Skinvio and its developers, affiliates, and service providers are not responsible for any health consequences, skin reactions, or medical issues that may arise from your use of the App or any recommendations provided by the App.

3. Description of Service

Skinvio is an iOS application that provides the following features:

Selfie-based skin analysis using AI technology
Skin score tracking and progress monitoring
Personalized skincare routine management
Cosmetic ingredient checking and product information
Account creation and cross-device sync
Premium subscription features (for Skinvio Premium subscribers)

We reserve the right to modify, suspend, or discontinue any features or the entire App at any time, with or without notice, and without liability to you.

4. User Accounts and Security

To access certain features, you must create an account. You are responsible for:

Providing accurate and complete information when creating your account
Maintaining the security of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate your account if we suspect any unauthorized use or violation of these Terms.

5. User Content and Responsibilities

When you use the App, you may provide content including selfie images, profile information, and routine data ("User Content"). You represent and warrant that:

You own or have the necessary rights to all User Content you provide
All selfie images you upload are of yourself only
You will not upload images of other people without their explicit permission
Your User Content does not violate any laws or these Terms
You are responsible for the accuracy of information you provide about your skin type, concerns, and goals

You grant Skinvio a limited, non-exclusive license to use, store, and process your User Content solely for the purpose of providing the App's services to you. We will not use your selfie images or personal information for any other purpose without your consent.

6. Skinvio Premium Subscription

Subscription Terms

Skinvio offers a premium subscription ("Skinvio Premium") that provides access to additional features. By subscribing to Skinvio Premium:

Your subscription will automatically renew at the end of each billing period unless canceled
You will be charged through your Apple ID account
The price may vary by region and is displayed in the App before purchase
Prices are subject to change with notice

Free Trials

We may offer a free trial of Skinvio Premium. Where a trial is available, its length and the price charged once it ends are shown in the App before you confirm the purchase.

Unless you cancel before the trial ends, your trial automatically converts to a paid, auto-renewing subscription and your Apple ID is charged the displayed price
To avoid being charged, cancel at least 24 hours before the trial period ends
Free trials are limited to one per Apple ID; if you have previously used a trial or introductory offer for Skinvio Premium, you may not be eligible for another
Trial eligibility is determined by Apple, not by Skinvio
If you cancel during the trial, you keep access until the trial period ends

Cancel a trial the same way you manage a subscription — see "Managing Your Subscription" below.

Billing and Auto-Renewal

Subscriptions are billed through Apple's App Store and managed through your Apple ID. Your subscription will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.

Managing Your Subscription

You can manage and cancel your subscription at any time through your Apple ID account settings:

Open the Settings app on your iOS device
Tap your name at the top
Tap Subscriptions
Select Skinvio and follow the prompts to manage or cancel

Cancellation takes effect at the end of your current billing period. You will continue to have access to Premium features until the end of the period you have paid for.

Refunds

All purchases are processed through Apple's App Store and are subject to Apple's refund policies. We do not process refunds directly. To request a refund, please contact Apple Support or visit reportaproblem.apple.com. Refunds are granted at Apple's sole discretion.

Free Trials

We may offer free trial periods for Skinvio Premium. If you subscribe during a free trial, you will not be charged until the trial period ends. You can cancel anytime during the trial period to avoid being charged. If you do not cancel, your subscription will automatically convert to a paid subscription at the end of the trial.

7. Acceptable Use Policy

You agree not to:

Use the App for any illegal purpose or in violation of any laws
Upload images of others without their explicit consent
Attempt to reverse engineer, decompile, or hack the App
Use automated tools to access the App (bots, scrapers, etc.)
Interfere with or disrupt the App's functionality or servers
Upload malicious code, viruses, or harmful content
Impersonate others or provide false information
Harass, abuse, or harm others through the App
Attempt to gain unauthorized access to other users' accounts or data
Use the App to distribute spam or unsolicited communications
Sell, rent, or transfer your account to others
Use the App in any way that could damage our reputation or business

Violation of this Acceptable Use Policy may result in immediate termination of your account and access to the App.

8. AI and Product Recommendations

Skinvio uses artificial intelligence to analyze your selfie images and provide skincare recommendations. You acknowledge and agree that:

AI analysis may not be 100% accurate or complete
Recommendations are general guidance and not personalized medical advice
Results may vary based on image quality, lighting, and other factors
Product recommendations are informational and not endorsements
We are not responsible for the quality, safety, or effectiveness of any products you choose to purchase based on our recommendations
You should conduct your own research and consult professionals before making decisions based on App recommendations

Skinvio may receive commissions or compensation from product database providers or affiliate programs, but product recommendations are based on the AI analysis and your profile, not on compensation.

9. Intellectual Property

The App, including its design, code, features, content, and trademarks, is owned by Skinvio and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

You may not:

Copy, modify, or create derivative works of the App
Distribute, sell, lease, or sublicense the App
Remove or alter any copyright, trademark, or proprietary notices
Use the Skinvio name, logo, or branding without permission

10. Account and Data Deletion

You may delete your account at any time through the Settings section of the App. When you delete your account:

Your account information, selfie images, scan history, and saved routines will be permanently deleted
This action cannot be undone
Some data may be retained in backups for a limited time
Anonymous analytics data may be retained

Important: Deleting your account does not cancel your subscription. You must cancel your subscription separately through your Apple ID settings to avoid future charges.

11. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for any reason, including:

Violation of these Terms or our Acceptable Use Policy
Fraudulent or illegal activity
Abuse of the App or other users
Non-payment of subscription fees
At our sole discretion

Upon termination, your right to access and use the App will immediately cease. Sections of these Terms that by their nature should survive termination will continue to apply.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Skinvio disclaims all warranties, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties regarding the accuracy, reliability, or completeness of the App's content or analysis
Warranties that the App will be uninterrupted, secure, or error-free
Warranties regarding the results you may obtain from using the App

We do not guarantee that the App will meet your requirements or that defects will be corrected. Your use of the App is at your sole risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKINVIO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

This limitation of liability applies to:

Any skin conditions, health issues, or adverse reactions resulting from products or recommendations
Errors or inaccuracies in AI analysis or recommendations
Loss of data or account access
Unauthorized access to your account or data
Service interruptions or technical issues
Any other matter relating to the App

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim, or $100, whichever is less.

14. Indemnification

You agree to indemnify, defend, and hold harmless Skinvio and its affiliates, officers, employees, agents, and service providers from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use or misuse of the App
Your violation of these Terms
Your User Content or any content you upload
Your violation of any rights of others
Your violation of any applicable laws or regulations

15. Third-Party Services and Links

The App may contain links to third-party websites, services, or content. We do not control or endorse these third parties and are not responsible for their content, privacy practices, or terms of service. Your use of third-party services is at your own risk and subject to their terms and policies.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by other means, such as email. The "Last updated" date at the top of these Terms will reflect the most recent changes.

Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and may delete your account.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

To the extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration.

18. Apple App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

These Terms are between you and Skinvio, not Apple
Apple has no obligation to provide maintenance or support for the App
Apple is not responsible for any product warranties or claims
Apple is not responsible for addressing any claims by you or third parties relating to the App
Apple is a third-party beneficiary of these Terms and may enforce them

19. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Skinvio regarding the App.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
